Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and ZENA COSMOS LLC (“ZENA COSMOS,” “we,” “us,” or “our”). They apply to the Daily Qi applications for iOS, watchOS, and macOS, related widgets and complications (together, the “App”), this website, and related support.

By downloading, accessing, or using Daily Qi, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Daily Qi.

2. Apple App Store terms

Your download and use of the App are also subject to the applicable Apple Media Services Terms and Apple’s Standard Licensed Application End User License Agreement (“Standard EULA”), unless a different license is presented through the App Store. If these Terms conflict with mandatory App Store terms, the applicable App Store terms control.

ZENA COSMOS—not Apple—is responsible for Daily Qi and its content, maintenance, support, and any warranties not disclaimed by law. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries may enforce applicable App Store license terms as third-party beneficiaries.

3. Educational and reference purpose

Daily Qi explains elements of traditional Chinese time culture, including solar terms, lunar-calendar notation, Heavenly Stems, Earthly Branches, Four Pillars, shichen, classical references, and traditional meridian or seasonal-wellness frameworks.

Do not use Daily Qi to make medical, safety, legal, financial, relationship, travel, agricultural, or other high-impact decisions. Consult a qualified professional where appropriate.

4. Calendrical accuracy and interpretation

We work to present accurate calculations and carefully edited cultural explanations. Results can nevertheless vary among calendrical schools, source texts, time-zone conventions, historical calendar systems, day-boundary rules, software versions, and device settings.

Solar-term reminders may be affected by time-zone changes, system Focus modes, Notification Summary, power management, permission settings, and operating-system behavior. We do not guarantee that a reminder will appear at an exact moment.

You are responsible for checking important dates or claims against an appropriate authoritative source.

5. Limited license

Subject to these Terms and the applicable App Store license, ZENA COSMOS grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Daily Qi for lawful personal, educational, and reference purposes on devices you own or control.

6. Acceptable use

You may not:

• copy, sell, sublicense, rent, redistribute, or commercially exploit Daily Qi except where law or an open-source license allows;
• reverse engineer, bypass security, or attempt to extract source code except where applicable law expressly permits;
• misrepresent Daily Qi content as medical advice, predictive certainty, or an official government or religious determination;
• use Daily Qi to violate law, infringe rights, distribute malware, or interfere with the App, website, or another person’s use; or
• remove copyright, trademark, attribution, or other proprietary notices.

7. Ownership and third-party materials

Daily Qi’s software, visual design, editorial writing, arrangement, branding, and original content are owned by ZENA COSMOS or its licensors and are protected by applicable intellectual-property laws. “Daily Qi” and associated marks may not be used to imply endorsement without permission.

Traditional calendrical concepts, historical source texts, and facts are not claimed as our exclusive property. Translations, commentary, selection, and presentation may be protected. Open-source components remain governed by their own licenses, listed on the Licenses page and in the App where applicable.

8. Availability and changes

We may update, correct, add, remove, suspend, or discontinue features or content. Operating-system updates, hardware differences, App Store availability, and third-party services may affect Daily Qi. We do not promise that every feature will remain available on every device or in every region.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY QI IS PROVIDED “AS IS” AND “AS AVAILABLE.” ZENA COSMOS DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. You may have rights that cannot be waived.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENA COSMOS AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, USE, PROFITS, OR GOODWILL; OR DAMAGES ARISING FROM RELIANCE ON CULTURAL, CALENDRICAL, REMINDER, OR WELLNESS CONTENT.

Where liability cannot be excluded, our total liability arising from Daily Qi will not exceed the greater of the amount you paid for the App during the twelve months before the claim or US $10. This limitation does not apply where prohibited by law.

11. Termination

You may stop using Daily Qi and delete the App at any time. Your license ends automatically if you materially violate these Terms. Provisions that by their nature should survive—including ownership, disclaimers, limitations, and applicable App Store rights—will survive termination.

12. Changes to these Terms

We may update these Terms as Daily Qi or applicable requirements change. We will post revised Terms here with a new effective date. If a material change requires consent, we will provide notice through an appropriate channel. Continued use after an effective update means you accept the revised Terms where permitted by law.

13. General terms

If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the relevant business.

These Terms, the Privacy Policy, and applicable App Store terms are the entire agreement between you and ZENA COSMOS concerning Daily Qi, except for terms that cannot legally be excluded.
